This page summarises the standard terms of our Service Agreement. Every project has its own signed agreement or work order with the exact scope, drawings, specifications, price and schedule, which prevails over this summary.
1. Scope of Work
The scope is defined in the approved drawings, Bill of Quantities (BOQ) and specification sheet attached to the agreement. Work not listed there is treated as extra work.
2. Drawings and Approvals
- Construction starts after the client approves the final drawings and specifications in writing.
- Where building plan approval is part of our scope, we prepare and file the documents; approval timelines depend on the authority.
3. Contract Price and Payment Schedule
- The contract price is fixed for the agreed scope and specifications, subject to the terms on material price variation, if any.
- Payments are made stage-wise, for example: booking, foundation, plinth, each slab, brickwork, plastering, flooring and handover.
- All payments are subject to applicable GST. Receipts are issued for every payment.
4. Materials and Quality
- Materials of the brands and grades listed in the specification sheet are used.
- Our engineers carry out regular quality inspections at each stage. The client may inspect the site with prior notice.
5. Timeline
The project timeline starts from the date of site handover and receipt of the first payment. It is extended for extra work, changes requested by the client, delayed payments, delayed approvals or force majeure events.
6. Extra Work and Changes
Any extra work or change is carried out only after the client approves its cost and time impact in writing.
7. Site Safety
We follow safety practices at the site. Visitors must follow the instructions of our site supervisor.
8. Handover and Warranty
- The building is handed over after final payment and a joint inspection.
- Structural defects and workmanship issues are covered for the warranty period stated in the agreement. Normal wear and tear, misuse and changes made by others are not covered.
9. Termination
Either party may terminate the agreement by written notice for a material breach that is not remedied within the notice period. Settlement is made as per our Refund & Cancellation Policy.
10. Disputes
Disputes are first resolved by mutual discussion. If unresolved, they are referred to arbitration under the Arbitration and Conciliation Act, 1996, with the seat at Berhampur, Odisha.
